BANDAR SERI BEGAWAN, NOV 25 – A total of five offenses were found during Alert Operation 259/2024 which was conducted by the Law Enforcement Division, Labor Department in several places in the area of Kampung (Kg) Jaya Setia for animal clinic and clothing shop activities; and at Kg Mentiri for restaurant activities on November 18.
The operation is conducted to enforce and ensure that the Employment Order 2009 is complied with by employers.
The offenses found are under the Employment Order 2009 committed by employers including Chapter 39(2) failing to pay overtime pay; Chapter 10 does not provide for a written service contract; Chapter 44 makes an unauthorized deduction of wages; Chapter 70 does not provide for gazetted public holidays; and Chapter 71 employers fail to provide annual leave.
For those offences, if found, the employer may be subject to a compound fine of not more than $1,000 for each offence. If you fail to pay the compound fine, the employer will be brought to court.
In relation to that, the Labor Department would like to remind employers to constantly monitor employee welfare affairs in line with the requirements of the Employment Order, 2009 such as paying overtime pay to employees, providing paid annual leave after three months of work and providing service contracts with employees.
