President-elect Donald Trump has said that he would, on Day 1, deport illegal immigrants even if they have U.S-born babies who are citizens. The Constitution effectively prohibits deporting American citizens. Using the military to aid in this deportation would need congressional approval and risks violating the 1878 Posse Comitatus Act.
In order to use the military, habeas corpus rights could be suspended. This would strip all Americans of legal protection for unlawful detention. Think now how the dictators in China, North Korea, and Russia would cheer, seeing how a democracy fails.
