WASHINGTON, DEC 3 – United States Special Counsel David Weiss objected to Hunter Biden’s request to drop the tax and gun charges against him after President Joe Biden granted a pardon, according to a court document.
Biden on Sunday signed an executive order to grant clemency to his son, Hunter, arguing that the decision was based on his belief in the unfairness of the prosecution.
President-elect Donald Trump criticized the pardon, calling it an “abuse of power and a travesty of justice.”
“The United States, through counsel of record, hereby submits an objection to the defendant’s motion to dismiss the charges, as set forth in the ‘Defendant’s Notice of Pardon’ (ECF No. 236).
“The defendant’s motion should be denied because there is no binding authority for this court to overturn the charges,” Weiss said in a filing dated Monday, Sputnik/RIA Novosti reported.
Weiss pointed out that the government does not deny that the defendant received an act of mercy, but that does not mean the charges against him should be “dismissed.”
He also said Hunter Biden’s claim that he was impeached “solely based on his status as the son of a serving President” was contrary to the facts given that the executive body that made the impeachment was headed by his father, according to the filing. – Named
