Operation Siaga found 4 mistakes by the employer

BANDAR SERI BEGAWAN, 24 OCT – Four offenses were found under the Employment Order 2009 committed by the employer during an inspection carried out at the cushion and sofa sewing activities in Jalan Muara area, recently.

The inspection was carried out by the Law Enforcement Division, Department of Labor in Standby Operation 230/2024, among other things aimed at enforcing and ensuring that the Employment Order 2009 is complied with by employers.

Of the four offences, two are offenses under Chapter 112(2) Employing foreign workers without a license from the Labor Commissioner where the employer is found to have employed foreign workers with tour pass guarantees and employing foreign workers from other companies as blacksmiths under construction activities.

While the other two offenses under Chapter 71 Failing to grant annual leave and Chapter 70 Failing to grant leave on public holidays are gazetted.

For the offense of violating the Employment Order 2009, if found, the original employer and the guaranteeing employer can be charged a compound of not more than $1,000 for the offense and if they fail to pay the compound, the employer will be brought to court.

In relation to that, the Labor Department reminds employers to constantly monitor employee welfare matters in accordance with the requirements of the Employment Order, 2009 such as employers who wish to employ foreign workers must obtain a license from the Labor Commissioner and guaranteed foreign workers must be given employment and work in the company own

In addition, the employee must also be given annual leave and give leave on gazetted public holidays.
