Charges brought against platform pushers in Berlin

The Berlin public prosecutor’s office has filed charges against a 32-year-old man. He is accused of bodily harm resulting in death.

The incident occurred on May 29, 2024. According to the public prosecutor’s office, a physical altercation occurred between the defendant and a 48-year-old man. The 32-year-old is said to have pushed his counterpart so hard that he first fell onto the edge of the platform and then onto the tracks.

The police were on site with a large contingent at the Oranienburger Straße S-Bahn station.

Although the defendant warned the driver of the incoming S-Bahn with hand signals, the driver was unable to stop in time despite emergency braking. The 48-year-old was hit by the S-Bahn and suffered fatal injuries.

According to the indictment, the 32-year-old is accused of having recognized the danger of the situation and yet acting with gross negligence. In particular, the proximity to the track bed and the victim’s clearly intoxicated state should have warned him to be more cautious. The indictment was brought before the Berlin I Regional Court.
