BANDAR SERI BEGAWAN, SEPT 8 – Six offenses under the Employment Order, 2009 were found to have been committed by employers in Standby Operation 197/2024 conducted by the Law Enforcement Division (BPU), Labor Department on September 3.

According to the statement, the operation carried out for air conditioning repair activities in Kampung Serusop Area has found six offenses committed by the employer, three offenses under Chapter 112, namely employing foreign workers without written permission from the Labor Commissioner, employing foreign workers guaranteed by other companies and workers found doing work inconsistent with the authorized position.

Then, under Chapter 70, the employer does not provide gazetted public holidays, Chapter 71, the employer fails to provide paid annual leave and Chapter 10, does not provide a written service contract with the employer guarantees.

For the offense of violating the Employment Order 2009, if found, the employing employer and the original employer may be subject to a compound fine of not more than $1,000 for the offence, and if the employer fails to pay the compound fine, the employer will be brought to court.

In relation to that, the Labor Department would like to remind employers to always monitor employee welfare matters in accordance with the requirements of the Employment Order, 2009 such as employers must employ foreign workers who are under the guarantee of their own company and not allow workers to work with other companies, employers must provide gazetted public leave to employees as well as provide paid annual leave after serving for three months with the same employer and the employer must also provide a service contract with guaranteed employees.
